H-2A housing requirements in Texas
Reviewed 2026-10-19 by the Workforce Housing Direct team
H-2A employers must provide housing at no cost to workers, and it must be inspected and approved before the date of need (20 CFR 655.122, using OSHA 1910.142 or ETA standards). Texas adds rules in 10 TAC Chapter 90, including smoke and CO detectors, fire protection, locks, 100 square feet per person where living, cooking, and sleeping are combined, and separation by sex or family. TDHCA licenses migrant labor housing facilities.
